Terms of Service for AI Audio

1. Introduction

Welcome to AI Audio, an AI-powered image generation application. These Terms of Service ("ToS") are a legal contract between you, the user, and AI Audio ("we", "us", or "our"), governing your use of the AI Audio application and services.

2. Acceptance of Terms

By creating an account, downloading, installing, or using AI Audio, you agree to be bound by these ToS. If you do not agree to all terms and conditions, do not use AI Audio.

3. Eligibility

You must be at least 13 years of age to use AI Audio. Users under 18 must have permission from a parent or legal guardian.

4. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Providing false contact information of any kind may result in the termination of your account.

5. Use of the Service

AI Audio allows you to generate images based on textual inputs using AI technology. You agree to use AI Audio only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of AI Audio. The Service is provided for personal, non-commercial use only.

6. Content and Conduct

You are solely responsible for the text inputs you use to generate images and any content you create, share, or display on or through AI Audio.
You must not use AI Audio to create, share, or display:
  • Illegal or unlawful content.
  • Infringing content that violates intellectual property rights.
  • Content that is defamatory, obscene, pornographic, offensive, hateful, or promotes violence or harm.
  • Content that violates privacy or publicity rights.
AI Audio reserves the right, but not the obligation, to review and remove or disable access to content that we determine, in our sole discretion, violates these ToS.

7. Intellectual Property Rights

The images generated by AI Audio are derivative works created by AI. You are granted a limited, non-exclusive, non-transferable license to use images generated by AI Audio for personal, non-commercial purposes.

8. License Grant to AI Audio

By using the Services, you grant to AI Audio, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense, and/or distribute text prompts you input into the services, or images produced by the service at your direction. The license granted to AI Audio remains in effect even after termination of this Agreement by any party, for any reason.

9. Privacy Policy

Your use of AI Audio is also governed by our Privacy Policy, which explains how we collect, use, and disclose information that pertains to your privacy.

10. Limitation of Liability

AI Audio and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service.

11. Changes to Terms

AI Audio reserves the right to modify these ToS at any time. We will provide notice of any significant changes by posting the new ToS on the service.

12. Termination

AI Audio may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including breach of these ToS.

13. Governing Law

These ToS shall be governed by the laws of the jurisdiction in which AI Audio is based, without regard to its conflict of law provisions.
